LIMITED WARRANTY - ASANKA

Eligibility

TECHAiDE Limited (“TECHAiDE”) provides this limited warranty to you, the purchaser of the Asanka product included in the sales package (“Product”). This limited warranty extends only to the original buyer and is valid and only enforceable in Ghana.

Duration of Warranty

TECHAiDE warrants the Product and its parts against defects in materials or workmanship for twelve (12) months from the date of original purchase by the end-user (“Warranty Period”). TECHAiDE warrants to you that during the Warranty Period, TECHAiDE will within a reasonable time, remedy defects in the Product without cost to you by repairing the defective part(s) or if TECHAiDE deems it necessary, by replacing the Product or the defective part(s) with new or reconditioned parts in accordance with the terms of this limited warranty. No claim shall be accepted after the Warranty Period.

All original parts (parts installed by TECHAiDE on the original system) which are replaced by TECHAiDE or any of its authorized service centers, shall be the property of TECHAiDE. Any after-sale addition or modification by you is not covered by this limited warranty. You, (the Product owner) are responsible for the payment for any service or repair provided by TECHAiDE or any of its authorized service centers outside the scope of this limited warranty.

Limitation of Liability

The limited warranty does not cover: (1) normal wear and tear; (2) any external scratch that occurs after the Product is delivered to the original owner; (3) any defect that does not cause adverse appreciable impact to basic functionality of the Product; and (4) defects caused by misuse of the Product.

In addition to the other exclusions in this limited warranty, TECHAiDE shall have no liability for damage to the Product due to power or voltage surges, improper handling of the Product (including operation, maintenance and installation) or negligence in transportation or storage of the Product. This limited warranty shall not be enforceable if the Product has been opened or repaired by a person other than TECHAiDE or any of its authorized service centers.

You are required to create back-up copies of any content created by you or stored by you on the Product as your content or data may be lost during repair or replacement of your Product. TECHAiDE shall not be liable to you for any damages arising from the loss of, or damage to your content or data during repair or replacement of the Product

Except as otherwise provided in this document, under no circumstances will TECHAiDE be liable to you for any: (1) cost; (2) expense; (3) inconvenience; (4) loss of profits; (5) loss of any existing or anticipated revenues; (6) loss of anticipated savings; (7) loss of business or business opportunities; (8) loss of use or productivity; (9) loss of content or data; and (10) any other incidental, indirect or consequential damages arising, directly or indirectly, from the sale or use of the Product, whether such claim is based on warranty, contract, indemnity, tort (including negligence), strict liability or otherwise, and whether or not foreseen or foreseeable by any party.

Warranty on Repaired or Replaced Product

For the avoidance of doubt, the Warranty Period will not be extended, renewed or affected by TECHAiDE’s repair or replacement of the Product or any of its part(s). The Product or its part(s) repaired or replaced during the Warranty Period will be warranted for the remainder of the original Warranty Period.

Registration of Product

You are required to register the Product at www.myasanka.com after purchase to enjoy this warranty. The Product registration number serves as the warranty and must be retained. TECHAiDE shall not offer any warranty service without this number.

Warranty Service

Any claim under this limited warranty is subject to the notification of TECHAiDE or any of its authorized service centers of any defect within a reasonable time after you discover the defect and by no later than the expiration of the Warranty Period. Any claim under this limited warranty must be accompanied by the Product, the Product registration number, receipt evidencing the purchase of the Product and the date of purchase of the Product and a description of the claimed defect. You may visit TECHAiDE’s office situated at A133/20, 11th Close, Dansoman, Accra, Ghana or visit any of TECHAiDE’s authorized service centers which can be found on www.myasanka.com.You may contact TECHAiDE or any of its authorized service centers found onwww.myasanka.com for enquiries.

If the claimed defect is accepted by TECHAiDE, TECHAiDE will, subject to the conditions set out in this limited warranty and at its own expense, arrange for the repair, replacement, or refund of the price or a part of the price of the Product as the case may be.

Disclaimer

Except as expressly set forth in this document, TECHAiDE makes no representation or warranty of any kind whatsoever, expressly or impliedly, including but not limited to any warranty of satisfactory quality, merchantability, fitness for use, fitness for a particular purpose, or conformity to any representation or description to the fullest extent permitted by law.

Defective Products

Subject to mandatory local law restrictions, under no circumstances shall the liability of TECHAiDE for defective Products under this limited warranty exceed the purchase price paid to TECHAiDE for the Product.

Priority of Limited Warranty

This limited warranty constitutes the entire agreement regarding warranties. No reseller, agent or employee is authorized to make any modification, extension or addition to this warranty. This limited warranty supersedes any prior written or oral communications on the subject matter and cannot be changed except by written agreement signed by authorized representatives of TECHAiDE. In case of conflict between this limited warranty and the sales agreement, this limited warranty shall prevail.

Governing Law

Notwithstanding anything to the contrary in the sales agreement between TECHAiDE and the buyer, any dispute, claim or obligation (whether contractual or non-contractual) arising out of or in connection with this warranty shall be governed by the laws of the Republic of Ghana.
